Welcome to Agent Advocate. These Terms of Service ("Terms") govern your access to and use of the Agent Advocate website, agentadvocate.net, and any related services (collectively, the "Service") operated by Agent Advocate LLC ("Agent Advocate", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Who We Are

Agent Advocate is an informational platform that helps freight agents evaluate brokerage programs through structured comparisons. We are not a broker, carrier, employer, recruiter of record, attorney, accountant, or financial advisor. The Service is provided for general informational purposes only.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Accounts

Some features require an account. You agree to provide accurate information, keep your credentials confidential, and notify us promptly of any unauthorized use. You are responsible for all activity under your account.

4. Acceptable Use

• Do not misuse, disrupt, or attempt to gain unauthorized access to the Service.
• Do not scrape, copy, or redistribute platform data without written permission.
• Do not submit false, misleading, or unlawful information.
• Do not use the Service to harass, defame, or harm others.

5. Information Accuracy & No Advice

Program data is compiled from contract materials, recruiter conversations, agent feedback, and public sources. Information may be incomplete, outdated, or inaccurate, and individual agreements often vary based on private negotiation. Nothing on the Service constitutes legal, financial, tax, employment, or contractual advice. Always independently verify program details and consult qualified professionals before making any decision.

6. Compensation Disclosure

Agent Advocate may receive a fee from certain brokerages if an agent chooses to join their program. This does not influence how programs are presented, compared, or displayed.

7. SMS / Text Messaging

If you provide your mobile number and opt in, Agent Advocate may send recurring SMS messages related to your inquiry, scheduled calls, account activity, or program updates. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP and get help by replying HELP. See our SMS Terms and Privacy Policy for details. Consent to receive SMS messages is not a condition of any purchase or service.

8. Intellectual Property

The Service, including all content, layouts, logos, trademarks, comparison structures, and software, is owned by Agent Advocate or its licensors and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal evaluation purposes.

9. Third-Party Content & Links

The Service may reference third-party brokerages, tools, or websites. We are not responsible for, and do not endorse, third-party content, products, or practices.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AGENTADVOCATE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION PROVIDED IS COMPLETE OR ACCURATE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AGENTADVOCATE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Agent Advocate from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Alabama and applicable United States federal law, without regard to conflict-of-law principles. You agree that any dispute will be resolved exclusively in the state or federal courts located in Alabama.

15. Changes to These Terms

We may update these Terms from time to time. The "Effective" date above reflects the latest revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.
